What’s the difference between gender, race and sexuality? Why the ECJ’s judgment isn’t obviously wrong

The European Court of Justice (ECJ) has recently come in for more than the usual amount of flak for a judgment on gender discrimination in insurance matters. In a short judgment on 1 March, the ECJ ruled that the insurance industry shouldn’t be allowed to opt-out of the EU’s 2004 Directive on Gender Equality. This was roundly criticised as nonsensical overreaching by “unelected, unaccountable” judges, and by some as “combining everything that is wrong with the EU’s judicial system”. Read full article »
